Data Collection on Our Website – Cookies:

The purpose of data processing is to analyze user behavior and measure the reach of our website and displayed advertisements, with the aim of optimizing our online offerings.

The data processed includes:

  • Google Analytics HTTP Data: This includes log data technically required for using the Google Analytics web analytics tool via the Hypertext Transfer Protocol (Secure) (HTTP(S)): IP address, browser type and version, operating system used, page visited, referring URL, date and time of access.

  • Google Analytics Device Data: Data generated by the Google Analytics web analytics tool and assigned to your device. This includes a unique identifier used to recognize returning users (known as the „client ID”) and certain technical parameters controlling data collection for web analysis purposes.

  • Google Analytics Measurement Data: Raw device data („dimensions” and „metrics”) collected and analyzed by the Google Analytics tool during your use of our online offering. This includes information on the sources from which visitors access our site, location data, browser and device used, website usage data (especially page views, access frequency, and time spent on pages), and goal completions (e.g., transactions in the online store). The data is linked to a client ID associated with your device, creating device-related usage profiles. All raw data are aggregated under a single client ID. The data we collect via Google Analytics does not allow us to directly identify users (e.g., by real name). We do not combine raw device data and associated usage profiles with data that directly identifies you personally without your consent.

  • Google Analytics Report Data: Data included in aggregated reports about segments and devices, created by Google Analytics based on the analysis of raw device data.

The legal basis for processing is Article 6(1)(a) GDPR (consent). The data is automatically provided by the user’s browser.

The data processing recipient under a processing agreement is Google Ireland Limited (Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland). Google Ireland Limited uses services provided by Google LLC in the USA (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). The legal basis for data processing in the USA is your consent given via the cookie consent banner (Art. 49(1)(a) GDPR). There is no data protection level in the USA equivalent to the GDPR. It is possible that government authorities may access personal data without our or your knowledge. Enforcing your rights in the USA is unlikely. You may withdraw your consent at any time with effect for the future using the “Individual Privacy Settings” button.

Providing this data is not legally or contractually required and is not necessary to conclude a contract. The data subject is not obliged to provide this data. However, without the data, we cannot carry out web analytics using Google Analytics.

Google Maps:

By activating the relevant fields in the cookie banner or in the “Individual Privacy Settings” to display Google Maps content, you agree that we allow Google to collect data for its own purposes. This is done by embedding map content stored by Google on our website. In this embedding, the map content from the Google Maps website is displayed within sections of the browser window. Before activating the relevant fields in the cookie banner or “Individual Privacy Settings” to view Google Maps content, no data is transmitted to Google, and no cookies are stored on your device.

Once the relevant fields in the cookie banner or “Individual Privacy Settings” are activated, content from Google Maps is loaded. Technically, this is the same as if you visited the Google Maps website via a direct link: Google receives all the information your browser automatically sends (including your IP address). Additionally, Google sets its own cookies on your device. This happens even if you do not have a Google user account. If you are logged into Google, your data is directly associated with your account. If you do not want your data to be linked to your Google user account, you must log out of Google before activating the relevant fields in the cookie banner or “Individual Privacy Settings.”

The collection and processing of this data is the sole responsibility of Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland. Google Ireland Limited uses services provided by Google LLC in the USA (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA).

We have no knowledge of any further details regarding the processing of personal data under Google’s responsibility, nor of any possible data processing taking place in the USA. Embedded Systems has no influence over how Google processes data.

Server Log Files:

The provider of our website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. The data in the log files includes:

  • Referrer URL (the website you came from)

  • Browser type, browser version, and language

  • Operating system and its interface

  • IP address (anonymized)

  • Time of the server request

  • HTTP status code – access status

  • Amount of data transferred

The storage period is 7 days. This data is not merged with other data sources.

The legal basis for data processing is Article 6(1)(f) GDPR, which permits data processing for the optimal presentation and security of the website based on our legitimate interest, provided this does not override your interest in the exclusion of data collection.

Interaction with Website Visitors

Contact Form:

When you send us inquiries via the contact form, the data you enter, including your contact information, is stored by us for the purpose of processing your inquiry and in case of follow-up questions. We do not share this data without your consent.

The processing of data entered in the contact form is generally based on Art. 6(1)(b) GDPR (initiation or performance of a contract). Your data will remain with us until you request its deletion or the purpose for storing the data no longer applies (e.g., after your request has been processed – provided we are not legally obliged to retain the data longer).

Inquiries via Email or Phone:

If you contact us via email or telephone, your inquiry, including all resulting personal data (name, inquiry details, etc.), will be stored and processed by us for the purpose of handling your request. We do not share this data without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR if your request is related to the performance of a contract or is necessary for pre-contractual measures. In all other cases, the processing is based on our legitimate interest in effectively handling the inquiries directed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if it has been requested.

The data you send us via contact inquiries will remain with us until you request its deletion, withdraw your consent, or the purpose for storing the data no longer applies. Mandatory legal provisions – especially retention periods – remain unaffected.


Communication via WhatsApp:

We use the WhatsApp messaging service to communicate with our clients, employees, and other third parties. Communication is end-to-end encrypted (peer-to-peer), preventing WhatsApp or third parties from accessing the content. However, WhatsApp does have access to metadata generated during the communication (e.g., sender, recipient, and timestamp).

The legal basis for processing this data is Art. 6(1)(a) GDPR (consent) and § 25(1) TTDSG, insofar as consent includes the storage of cookies or access to device information (e.g., device fingerprinting) under the TTDSG. Consent can be withdrawn at any time. Additionally, we have a legitimate interest in efficiently managing customer service, responding promptly to concerns, and optimizing our service offerings, based on Art. 6(1)(f) GDPR.

The recipient of your data is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. We have concluded a data processing agreement with WhatsApp to ensure the protection of your data and to prevent unauthorized disclosure to third parties.

Furthermore, we have agreed with WhatsApp that customer data will be processed exclusively on servers within the EU, minimizing data transfers to the USA. However, data transfer to the USA cannot be completely ruled out. Please note that WhatsApp, according to its own statements, shares personal data with its parent company, Meta Platforms, in the USA. Meta Platforms is located in Menlo Park, California, USA. Currently, there is no adequacy decision by the European Commission for the USA. Data transfer is therefore based on standard contractual clauses as appropriate safeguards for protecting personal data. Both Meta Platforms and U.S. authorities may have access to your data. The communication content exchanged between you and us on WhatsApp remains with us until you request its deletion, withdraw your consent, or the purpose of data storage no longer applies (e.g., once your request has been processed). Mandatory legal retention periods remain unaffected. However, complete deletion of your data from WhatsApp and Meta Platforms cannot be guaranteed due to lack of access.


Plugins

Google Web Fonts:

This site uses so-called web fonts provided by Google for a uniform display of fonts. When you load a page, your browser downloads the required web fonts into its browser cache to correctly display texts and fonts. These fonts are stored there for 1 year to reduce loading times. Additionally, administrative effort and potential errors in font updates via Google are minimized.

To do this, the browser you use must connect to Google’s servers. As a result, Google becomes aware that our website was accessed via your IP address (along with browser and device data). The use of Google Web Fonts is in the interest of a consistent and visually appealing presentation of our online services. This constitutes a legitimate interest under Art. 6(1)(f) GDPR.

If your browser does not support web fonts, a default font from your computer will be used.

Privacy Policy Regarding Our Facebook Presence

The purposes of our Facebook page are:

  • Direct contact with our online visitors, aimed at acquiring and retaining employees and customers, offering modern communication channels

  • Sharing information about our services and offers

  • Conducting statistical analyses for our own market research

According to Art. 6(1)(f) GDPR, the use of this social media channel is in our legitimate interest. Nevertheless, we consider it important to inform you as transparently as possible about data protection issues for which we share responsibility.

When you visit our Facebook page, Facebook collects, among other things, your IP address and other information stored on your device in the form of cookies. This information is used to provide us, as page operators, with statistical insights on the use of our page. If you want to avoid this, log out of Facebook, disable the “stay logged in” function, and configure your browser to prevent cookies or delete them immediately.
